It is the policy of The Bank (“the bank”, “bank”, “we”, “us”, or “our”), including any assumed names, to comply with applicable laws and regulations, and to conduct business in accordance with applicable safety and soundness standards.
Transactions creating an overdraft (“OD” (negative)) balance can occur in person, at the ATM, through online banking, including bill pay, or telephone banking. A nonsufficient funds (“NSF” (negative)) / overdraft (“OD” (negative)) balance may result from,
- The payment of checks, electronic funds transfers, or other withdrawal requests,
- Payments authorized by you,
- The return of unpaid items deposited by you,
- Our Fee(s) (“Charge(s)”),
- The deposit of items which, according to our Funds Availability Policy, are treated as not yet “available” or finally paid.
We are not obligated to pay any item presented for payment if your account does not contain sufficient collected funds. Rather than automatically returning, unpaid, any NSF items that you may have, if your eligible account remains in good standing, which includes at least: (A) Continuing to make deposits consistent with your past practices, (B) You are not in default on any loan obligation to us, (C) You bring your account to a positive balance (not overdrawn) at least once every thirty (30) days, and (D) Your account is not the subject of any legal or administrative order or levy, we will consider, without obligation on our part, approving your reasonable overdrafts as a purely discretionary “privilege” or “courtesy”. This discretionary service will generally be limited to $100 overdraft (negative) balance depending on eligible personal checking account type, (subject to approval). Of course, any and all fees, including, without limitation, our applicable NSF / OD fees, as disclosed in our separate Schedule of Fees, will be included in this limit and will apply to any transaction that may overdraw your account (see eligible account and transaction types disclosed within this disclosure).
We may refuse to pay any NSF / OD item for you at any time, even if your account is in good standing and even though we may have previously paid NSF / OD items for you. You will be notified by mail of any NSF items paid or returned that you may have; however, we have no obligation to notify you before we pay or return any item. The amount of any overdraft item plus our applicable NSF and/or OD fee(s) that you owe us shall be due and payable upon demand. If there is an NSF item paid by us on an account with more than one (1) owner on the signature card, each owner, and/or agent if applicable, presenting the item creating the overdraft, shall be jointly and severally liable for such overdraft plus our applicable NSF and/or OD fees.
Fees: Fees may be imposed for overdraft created by check, in-person withdrawals, ATM withdrawals or other electronic transactions as follows:
- Applicable NSF / OD fee(s), as disclosed in our separate Schedule of Fees, each time we pay or return an NSF item (with the exception of ATM withdrawals and everyday debit card transactions unless you have provided consent by “opt-in”)
- The daily maximum NSF / OD fee will not exceed the equivalent of one (1) NSF/OD items as disclosed in our separate Schedule of Fees which may be found on our website at www.tcbssb.com or you may request a copy from a Financial Service Representative at one of our convenient Banking Locations.
Eligible Account Types: The account types that are eligible for Overdraft Privilege Service are limited to transaction account types the bank offers at the time you apply for it. Savings accounts, including Money Market accounts, are not eligible. We may limit the number of accounts eligible for Overdraft Privilege Service to one account per household and/or one account per taxpayer ID.
Optional Overdraft Protection Service: If you have another account type with us you may request an automatic NSF / OD transfer by completing and signing the required form. A nominal fee will be assessed for this service as disclosed in our separate Schedule of Fees. By requesting this service you may save money on NSF / OD fees you pay us for items trying to pay against a negative balance.
Customer Opt-Out: You may choose at any time not to participate in our Overdraft Privilege Service by notifying a Financial Service Representative at one of our convenient Banking Locations.
If you need help: Of course, overdrafts should never be used to finance ordinary or routine expenses, and you should not rely on overdrafts to cover these expenses. If at any time you feel you need help with your financial obligations, please contact us at any of our convenient Banking Locations.
Always a Discretionary Service: Our Overdraft Privilege Service does not constitute an actual or implied agreement between you and us. Nor does it constitute an actual or implied obligation of ours or by us. This service represents a purely discretionary privilege or courtesy that we may provide to you from time to time and which may be withdrawn or withheld by us at any time, without prior notice, reason or cause.
